Refund Policy

This Refund Policy explains what happens to any amount you pay while using www.xpertauction.comor the XpertAuction mobile application (the “Platform”) operated by Navodayan Proptech Private Limited(CIN: U68100DL2024PTC433778) under the brand “XpertAuction” (“we”, “us”, “our”). This Policy is to be read together with our Terms & Conditions and Privacy Policy.

1. All EMD and Bid-related Refunds Are Processed by the Client Bank — Not by XpertAuction

Every rupee you pay towards Earnest Money Deposit (“EMD”), bid amount, sale consideration, stamp duty, registration fee or any other statutory or sale-related charge is credited to and controlled by the client bank, non-banking financial company, asset reconstruction company, housing finance company or other financial institution (each a “Client”) that has listed the auction. XpertAuction does not hold, invest, appropriate or benefit from any of these amounts at any stage.

All refunds — whether of EMD by non-winning bidders, excess balance to a winning bidder, refund on cancelled auctions, or refund on any sale that does not go through — are governed entirely by the Client's sale notice, tender terms & conditions, and the Client's internal treasury policy. Timelines, deductions, TDS, documentation requirements and mode of refund are decided by the Client. XpertAuction has no authority to expedite, reduce, augment, guarantee or influence any such refund.

Please contact the respective Client's Authorised Officer for all refund queries and follow-ups. The Authorised Officer's contact details are printed on the sale notice, which is available on the auction listing page under “Sale Notice / Notice (EN)” and “Notice (Vernacular)”.

2. Standard EMD-refund Scenarios (Client-controlled)

For quick reference, the typical scenarios are set out below. The definitive treatment for any specific auction is the one in the Client's sale notice.

  • Non-winning bidder:the Client normally refunds the EMD to the same bank account from which it was remitted within the period specified in the sale notice (commonly 7–15 working days from close of auction). If the payment was made via the Platform's wallet, the EMD is unlocked and released to your wallet balance from where you may withdraw to your registered bank account.
  • Winning bidder / successful sale: EMD is adjusted against the sale consideration payable to the Client. Refund does not arise.
  • Winning bidder / failure to remit balance: the EMD is forfeited by the Client per Rule 9 of the Security Interest (Enforcement) Rules, 2002 and the sale notice. XpertAuction cannot reverse a forfeiture.
  • Auction cancelled or postponed by Client: EMD is refunded per the Client's revised sale notice.
  • Bidder disqualified for KYC or eligibility reasons: the Client decides forfeiture or refund per the tender terms; XpertAuction only records the Authorised Officer's decision.

3. Payment Gateway Charges and Deductions

Where you top up the wallet via a payment gateway (Razorpay or such other gateway as we may integrate), the gateway may levy convenience charges that are typically deducted upfront and are non-refundable. Bank transaction charges for RTGS, NEFT, IMPS or UPI, and any TDS applicable under the Income Tax Act, 1961 are also non-refundable and are borne by the bidder.

4. Refunds of Platform Fees Charged Directly by XpertAuction

As of the effective date above, XpertAuction does not charge any registration, participation, KYC, EMD, quote or bidding fee to bidders. If, at any time in the future, we introduce an optional paid service (for example, priority helpdesk, document authentication assistance, advisory reports), the refund terms specific to that paid service will be published on this page and on the checkout page. Until such publication, no bidder should pay any amount to XpertAuction.

5. Zero-Cash Policy — If Anyone Demands Money in Our Name

XpertAuction never accepts cash, cash-equivalent, gift voucher, cryptocurrency, or off-platform electronic transfer from any bidder, and we have not authorised any employee, agent, franchisee, sub-contractor, associate, representative or third person to collect any amount from any bidder in our name.

If any person, calling themselves a representative or agent of XpertAuction, demands payment from you outside the Platform, please do not pay them. Instead, report the incident immediately to report-fraud@xpertauction.com or call +91 99991 05933. We will assist you in filing a police complaint if required. Any amount paid to an unauthorised person is not recoverable from us.

6. Chargebacks & Payment Disputes

Any chargeback initiated by you with your card issuer, gateway or bank in respect of an EMD payment where the funds have already been transferred to the Client's account will be defended by us with the payment gateway and, if succeeded by you fraudulently or without proper cause, may attract action for recovery, restriction of your account, and reporting to the concerned authorities under the Payment and Settlement Systems Act, 2007 and other applicable law.

7. How to Reach the Right Party

  • EMD refund status / delay:contact the Client's Authorised Officer listed on the sale notice. XpertAuction can only forward the query on your behalf; the decision and remittance rest with the Client.
  • Wallet balance dispute (Platform-side): email eauctions@xpertauction.com with your transaction reference.
  • Suspected fraud or extortion in our name: email report-fraud@xpertauction.com or call +91 99991 05933.
  • Grievance escalation: email grievance@xpertauction.com. We will respond within 15 days as required under Rule 3(11) of the Intermediary Guidelines, 2021.

8. No Waiver of Rights

This Refund Policy does not create any obligation on XpertAuction to refund monies that were never received by XpertAuction, and does not vary any refund entitlement that arises directly from the Client under the sale notice or applicable law. Your entitlement to a refund from the Client is not, and shall not be construed as, a waiver of any of your obligations to XpertAuction under the Terms & Conditions.

9. Governing Law & Disputes

This Refund Policy is governed by the laws of India. Any dispute is subject to the dispute-resolution clause in the Terms & Conditions. Subject to arbitration, the courts at New Delhi have exclusive jurisdiction.
